Which of the following statements with respect to victim compensation is incorrect?
Under section 357(1), Cr. P.C. the court can direct the accused to pay compensation only if the accused is punished with a sentence of fine or with some other sentence of which fine is a part. Amount of compensation cannot exceed the amount of line that can be imposed under the section for which the person has been convicted, and the amount of fine that particular court May impose by law.
Under section 357(3), Cr. P.C. a court can award compensation even if fine is not part of the sentence. There is no limit on the amount of compensation that the court May ask the accused to pay the victim.
If a person is acquitted of a crime, the trial court cannot make a recommendation of compensation under section 357A, Cr. P.C
If a crime has been committed, the victim is identified, but the accused cannot be traced, the victim can make an application or compensation to the state or district legal services authority
