In the S R Bommai v. Union of India case, Secularism was upheldby the Supreme Court as a basic structure of the Constitution ofIndia. The Court observed that ‘Secularism is also a part of basicstructure as the basis of the Indian Constitution is that all citizens are equal and that the religion of a citizen is irrelevant in the matter of his enjoyment of Fundamental Rights. The Constitution ensuresequal freedom for all religion and provides that the religion of thecitizen has nothing to do in socioeconomic matters.’ The Courtfurther said that ‘the concept of secularism is not merely a passiveattitude of religious tolerance. It is also a positive concept of equaltreatment of all religions. The concept of positive secularismseparates spiritualism with individual faith’.
