Statements (1) and (2) with regard to preventive detention in India are correct. Statement (3) is incorrect as the detaining authorities must give the detainee earliest opportunities for making representation against detention. These safeguards are designed to minimise the misuse of preventive detention but this is not a proper ground to grant bail. Preventive detention is the most contentious part of the scheme of fundamental rights in the Indian Constitution. Article 22 (c) of the Indian Constitution provides that if a person is arrested or detained under a law providing for preventive detention, then the protection against arrest and detention under Articles 22 (a) and 22 (b) shall not be available.
