Statement (a) is incorrect with respect to the protection of individuals being tried for offences. Section 164 of the Criminal Procedure Code, 1973 provides that a confession made to a magistrate is admissible and can be used as an evidence against him, provided it is voluntary. Article 20 deals with the protection of certain rights in case of conviction for offences. Clause (a) of Article 20 protects individuals against ex post facto legislation, which means no individual can be convicted for actions that were committed before the enactment of the law. The Constitution of India prohibits double punishment for the same offence. That is reflected in clause (b) of Article 20. According to this clause, no person shall be prosecuted and punished for the same offence more than once.
