• Parliamentary privilege are rights and immunities enjoyed by Members of Parliament in their individual capacity. • Article 105 of the Constitution of India which provides for powers, privileges and immunities of the Houses of Parliament and of the members and the Committee. • The privileges of the MPs are not fettered by the Article 19(1)(a) of the Constitution of India and they must be read subject to the Articles 20-22 and Article 32 of the Constitution of India. • The MPs are provided immunity from any proceedings, civil or Criminal, in any court in respect of the publication in a newspaper or a substantially true report of the proceedings of either House of Parliament unless the publication is provided to have been made with malice. • This immunity is not available in private capacity.
