1967 (चौथे आम चुनाव) के बाद दल-बदल की राजनीति भारतीय राजनीति की एक महत्वपूर्ण विशेषता रही है। इसी के फलस्वरूप 1985 में संसद ने 52वें संविधान संशोधन अधिनियम के द्वारा इस प्रवृत्ति को नियंत्रित करने के लिए 'दल-बदल विरोधी अधिनियम' पारित किया तथा संविधान में 10वीं अनुसूची को जोड़ा गया। जिसमें बहुत से प्रावधान दिए गए हैं। यह अधिनियम सदस्यों की निर्हरता qualification) या अयोग्यता का विधान करता है। इस अधिनियम के कुछ महत्त्वपूर्ण प्रावधान निम्न है- i) अगर किसी पार्टी के 2∕3 सदस्य या अधिक दूसरी पार्टी में विलय करने के इच्छुक है, तो उन सदस्यों को निरह नहीं ठहराया जा सकता है। ii) यदि कोई निर्दलीय सदस्य किसी राजनीतिक दल में सम्मिलित होता है, तो उसकी निरह ठहराया जाएगा। iii) लोक सभा का अध्यक्ष या उपाध्यक्ष, राज्य सभा का उपसभापति, विधान सभा का अध्यक्ष या उपाध्यक्ष तथा विधानपरिषद् का सभापति-संघ व राज्य विधायिकाओं के ये पदाधिकारी इस अधिनियम के अंतर्गत निरर्हित (disqualified) नहीं होगें, यदि अपना पद छोड़ने के बाद वे पुन: अपनी राजनीतिक पार्टी में सम्मिलित हो जाते हैं। परन्तु ये सदस्य किसी दूसरी राजनीतिक पार्टी में सम्मिलित होते हैं, तो उन्हें निरर्ह ठहराया जाएगा।
