When a Proclamation of Emergency is in operation, the right to move a Court for the enforcement of all Fundamental Rights remains suspended, except for Article 20 and Article 21 of the Constitution of India. It was recognised by the Supreme Court that there are certain basic human rights which cannot be suspended during any kind of emergency, be it war or armed rebellion or civil insurrection. These rights are so basic that their suspension destroys the basis of a civilised state and the Rule of Laws. Article 20 of the Indian Constitution provides for the protection in respect of conviction of offences. Article 21 states that no person shall be deprived of his life or personal liberty except according to the procedure stated by law.
